Data Protection: Brussels says the scale of financial penalties


The European Commission is preparing a series of proposals to strengthen the protection of digital data coupled with possibility of sanctions up to one million euros, or 5% of the turnover of a company, according to documents that the Agency France -AP obtained, Tuesday, January 17.

The draft directive and regulation prepared by the services of the European Commissioner for Justice, Viviane Reding, and should be presented on January 25, aimed at allowing Internet users to have greater control over their personal data. In particular it is expected that citizens can make claims a “right to oblivion Digital” , which will require particular social networks to remove the personal data (photos and other) users who request it.

More generally, the ability of individuals to control their personal data on the net will be strengthened: they will give their “express consent” to the use of their data by companies and will be able to have easy access when they ask. Individuals may also benefit from “data portability” : they have the right to obtain a copy of the data available to the service provider and will be migrating data from one provider to another without being penalized.

Of financial penalties

Companies will have to inform people on what they do with their personal data, and they will also have their notified immediately if they have been leaked. In case of violation of these rules, fines can go up to one million euros for individuals and 5% of global sales for businesses. For several years, the European Commission has undertaken to reform the European legislation on data private, in force since 1995.
